Discovery Yachts Group Ltd has appointed administration – and been sold in a pre-pack deal – following the conclusion of undefended court action which has left the company owing nearly £1.2m according to Boating Business .

This comes after a couple was awarded £1m for being sold a leaky ship they branded ‘HMS Disappointment’.

According to the Daily Mail , Andrew and Maria France bought the Elusive for £1.5m in 2017 after a house fire. The former deep-sea diver, 58, and his wife planned to sail around the world, but the ship developed leaks, navigational glitches and proved unseaworthy.

The couple wanted Elusive to become their new home and for her to be fit for long-term habitation and extended periods at sea, his barrister, Noel Casey, told London’s High Court. But they had to ditch their dream due to multiple ‘defects on the yacht’ which rendered her ‘unfit for purpose’ and ‘not suitable…for blue water cruising’.

They claimed the vessel was ‘not fit to sail’ the high seas and ‘not watertight,’ with one of the cabins flooding just three days after the boat was delivered.

Andrew France, 58, sued Southampton-based Discovery Yacht Sales Ltd (DYS), from whom he bought his boat, and Discovery Yachts Group Ltd, which dealt with and supported France after a buyout of DYS in April 2017.

In late December 2019, High Court judge Mr Justice Teare ruled in the Frances’ favour against both companies, awarding around £1m in compensation.

The judge said the faults were caused by the failure of the seller to ensure it complied with the specification, was of satisfactory quality and was fit for purpose.

“The yacht appears to have been delivered hurriedly and before it was ready to be delivered,” he said. “It was delivered without an adequate sea trial or commissioning.”

And he said he was satisfied that Discovery Yachts Group had agreed to ensure that repairs outstanding in September 2017 would be completed.

Defence lawyers had argued that ‘inexperienced’ sailors should bear part of the blame for the defects, which they said were caused by ‘negligent seamanship or a lack of maintenance and competence’.

The court heard that France had spent over 20 years working as a saturation deep sea diver before he set his heart on seeing the world from his own boat and splashed out on Elusive.

Defects showed up soon after her delivery on January 12, 2017, the court heard.

“On the first day of her maiden voyage, the mast collar began to leak, and on 15 January the forward cabin was flooded with water because of an unfinished cable penetration in the watertight bulkhead,” explained Mr Justice Teare.

Over the next few months, a range of further problems emerged, lawyers said, including a sail block ‘disintegrating’ and the davit arm – a crane-like structure used for lowering the yacht’s lifeboat – coming loose, leaving the dingy dragging in the water behind the yacht.

Problems continue

On January 18, Elusive berthed in La Coruna, Spain, for repairs, but the mast continued to leak and the professional skipper who was helping France find his feet reported: “Crew morale is extremely low.”

On January 29, she set sail for the Caribbean on the Atlantic leg of her world cruise, but was forced to retreat to the Canary Islands when her generator packed in.

The skipper reported: “We are suffering problems never experienced before and the general feeling is that the boat is not fit.”

Other problems included the navigation equipment playing up and the autopilot temporarily ‘shutting down’.

France reported that Elusive was attracting ‘admiring glances’ from fellow sailors due to her appearance, but complained: “I am embarrassed to show them the state of the boat, with blue tape holding drawers and cupboards shut, towels to catch water leaks, badly stained furniture and stink of diesel in the saloon.”

But by May 2017, Elusive had reached Antigua, where he claimed Discovery Yachts Group personnel effected superficial repairs after he sent out a list highlighting the defects.

The same month, he sent a ‘message of complaint’ to Discovery Yachts Group, which read: “Surely this is not the standard of build quality one should expect when spending £1.5m. At this time the boat is not fit to sail, and certainly not fit for an ocean passage. I have no confidence in the boat.” France referred to it as ‘HMS Disappointment’ in a later message.

Annapolis repairs

Elusive’s next port of call was Annapolis, where Discovery Yachts Group carried out further repairs on the boat in September 2017, but the couple were ‘underwhelmed by the work’.

France said he even agreed to let Discovery Yachts Group exhibit Elusive at the October 2017 Annapolis Boat Show if they overhauled her with full repairs.

Justice Teare backed France’s claim, ruling: “It is plain that an agreement had been reached whereby in return for the yacht being exhibited at the Boat Show the outstanding items of repair would be carried out.”

France’s legal team said Elusive remains vulnerable in the high seas and is ‘not watertight’, although capable of tackling calm waters, according to the Daily Mail .

The yacht, which should have become the couple’s permanent base, is now beached on a stand near Lymington awaiting an overhaul, while France and his wife are in rented accommodation.

Neither company was represented in court, but in their defence partly blamed France for the yacht’s troubles, while Discovery Yachts Group also maintained it had no contractual relationship with France or his company. It was under no obligation to put right any defects in the yacht but had made ‘extra efforts’ to assist him by doing repairs, the company claimed.

The judge awarded France about £900,000 from DYS, based on the reduced value of the boat. Discovery Yachts Group is liable to pay £260,000 in repair costs, he said.

On top of that, they must together pick up France’s legal costs bill, which his lawyers have estimated at £432,000.

Both DYS and Discovery Yachts Group had their defences ‘struck out’ at the start of the trial when neither party appeared in court.

Shortly before the trial kicked off, ‘notice of an intention to place DYG into administration’ had also been served, the judge said.

According to Boating Business the company appointed Chris Moore of K J Watkin & Co. as liquidator on 9 December 2019 and went into administration ten days later. Continuity of employment has been assured.

“Immediately upon appointment, a pre-pack sale was completed to Binti Marine Holdings Limited, a UK subsidiary of Binti Holding GMBH,” says Simon Wall of K J Watkin & Co.

“This business rescue has ensured continuity of employment for all employees and all yachts in build will be completed.”

It is unclear whether Discovery Yachts Sales Ltd has also appointed administrators.

Ocean Shipyard takes over Discovery Shipyard's buildings

In the absence of a buyer, the sailboat manufacturer Discovery Shipyard was finally placed in receivership in January 2022 after its main shareholder refused to invest again in the company, which still employed several dozen people.

Only a few months later, a new shipyard , called Ocean Shipyard Limited, was formed and took over the production facilities in Southampton, southern England. The new company is headed by Steve Edwards, former managing director of Discovery Shipyard .

Do not limit yourself to the production of new boats

The new shipyard wants to take advantage of the quality of its industrial tool and its personnel, many of whom are Discovery Yachts employees. In particular, it intends to offer the services of its carpentry workshop for the fitting out of boats and its boat maintenance facilities. He also intends to offer his services to companies beyond the maritime sector to be less dependent on the vagaries of the nautical market.

However, Ocean Shipyards is the heir of Discovery Shipyards and its objective is to continue building new yachts. The company has secured the intellectual property rights and tooling related to the production of the former shipyard's boats. The new entity offers its customers the Southerly brand of monohull sailboats, as well as the Bluewater 50 catamaran, a semi-custom range designed for wealthy yachtsmen.

Southampton based Discovery Yachts Group has today announced the acquisition of the Southerly range of swing keel cruising yachts

Discovery Yachts has bought fellow British cruising yacht brand Southerly in a bid to become one of the UK’s leading yacht builders.

It means Discovery will have a highly versatile range of quality cruising yachts, both swing keel and fixed keel monohulls and catamarans from 32 to 67ft.

A new product launch for the Southerly brand will be announced at the Southampton Boat Show this September and Discovery Cataramans will have their own ‘Bluewater’ branding too

The Southerly brand, under Northshore Yachts, went through two bankruptcies in 2013 and 2014. The builder, which once employed 165 people at its Itchenor Shipyard, was rescued from receivership with debts of nearly £2m – before it went bankrupt again the following year with the loss of 50 jobs and a reputed list of creditors owed.

The surprising part is that no other builder has since tried to fill the niche that the popular variable draught yachts had created. Southerly formed in 1978 and has over 900 owners worldwide.

It looks like a smart decision by Discovery to extend the range and versatility of its brand with another that fits well in its portfolio. The modern Rob Humphreys and Stephen Jones designed Southerlys are excellent designs that were built to a high standard.

Discovery’s Managing Director Sean Langdon points out that the only other proper variable draught production yachts are French aluminium models. He told us that he has he been trying to buy the Southerly brand for a few years now. He ended up buying Discovery and then Southerly, convinced that the only way to start Southerly up again “was with another prominent brand.”

The sale includes ‘everything other than the people and buildings’ – ie the moulds and the name (the assets were never in the company name reportedly). Northshore Yacht Services, located at their shipyard at Itchenor, Chichester Harbour, will continue to be an approved specialist Southerly refit and repair centre and Southerly Yacht Brokerage.

Langdon says that the existing Southerly models will be refreshed and rebranded with ‘simpler’ number systems – two for Discovery, three for Southerly. So the Southerly 32 will become a 330, the 38 a 390 and the centre cockpit models will have a five in them (42 will be 425).

“The branding will be kept very separate,” says Langdon, adding “but there is the potential to share tooling for two different brands.” So we can expect to see the new Discovery 48 launching next year , offered as a swing-keel cruiser under the Southerly brand for example.

New Southerly models will now be built at Discovery’s Marchwood facility and include its typically high level of interior finish. Langdon is taking on 10 new staff in the coming weeks and plans to add another 20 during the year to take employee numbers back up to 90 by the end of 2017.

“I truly believe that Southerly and Discovery, with the catamarans alongside, will give us a really strong group going forward,” said Langdon.

Former Discovery Yachts director ordered to make £1m payout

Andrew France and his wife Maria bought the 58-foot Discovery sailing yacht ‘Elusive’ for £1.5 million in January 2017. They sued Southampton based boat broker Discovery Yachts Sales Ltd (DYS) and Discovery Yachts Group Ltd – claiming the boat was ‘not watertight’, after one of the cabins flooded just three days after delivery.

Following a Supreme Court trial in December 2019, Judge Justice Teare upheld the claim against both companies and awarded the couple more than £1 million in compensation and costs. Mr Langdon then challenged a Supreme Court decision last year which found that he was personally liable. But the latest court hearing chucked out the appeal and upheld rules which automatically hold executives liable for their company’s debts.

The court decided that Mr Langdon is responsible for a payout after he admitted to unknowingly violating Section 16 of the Insolvency Act by continuing to use the name ‘Discovery’ following the liquidation of Discovery Yachts Ltd, which went into voluntary liquidation in January 2022.

Discovery Shipyard Limited’s Southerly 42, Southerly 48 and Bluewater 50 Catamaran are to be built by a new UK shipyard

Ocean Shipyard Ltd has secured exclusive rights to hand build the vessels following the demise of Discovery.

Run by Discovery Shipyard’s former general manager, Steve Edwards, Ocean Shipyard will also offer joinery and refit facilities, and is now operating from Discovery Shipyard’s former Southampton yard.

Discovery went into voluntary liquidation in January, with 77 staff made redundant.

The COVID-19 pandemic, declining orders and supply chain issues were blamed for the closure.

In a statement to Yachting Monthly , liquidators Interpath Advisory said it was progressing with the sale of assets.

‘Discovery Shipyard Limited owned minimal assets. A third party agent has been appointed to market those assets and offers have been received and accepted.

‘The assets include a forklift truck, a van, IT equipment and assorted hand tools and consumables,’ concluded the statement.

According to the UK’s Companies House records, Steve Edwards is now a director of Binti Marine Holdings Ltd, the original holding company of Discovery Shipyard. It follows the resignation of the previous director/owner Werner Schnabele.

Binti Holding GmbH is still listed as a ‘Persons with significant control’ of Binti Marine Holdings Ltd .

According to Company House records in Germany, Schnabele is the managing director of Binti Holding GmbH .

Steve Edwards and Binti Marine Holdings Ltd are listed as ‘Persons with significant control’ of Ocean Shipyard Ltd , according to Companies House records.

Wener Schnabele was one of 401 people who invested £2.2 million in Discovery after a fundraising campaign via Crowdcube.

He became the sole owner of the shipyard in December 2019.

In January 2021, it was announced that Schnaebele had invested a further £2 million in Discovery to be used exclusively on capital expenditures as well as project development including the newly designed Bluewater 50 Catamaran Mk 3, a redesigned Southerly 42 with lifting keel and improvements to the yard’s existing tooling.

Last year, Discovery announced a surge in its order books, including five new models sold off plan.

Divers find 5 bodies during search of superyacht wreckage after it sank off Sicily, 1 still missing

Divers searching the wreck of a superyacht  that sank off Sicily found the bodies of five passengers Wednesday and searched for one more as questions intensified about why the vessel sank so quickly when a nearby sailboat remained largely unscathed.

Rescue crews brought four body bags ashore into port at Porticello. Salvatore Cocina, head of the Sicily civil protection agency, said a fifth body had been located. Divers at the scene said they would try to recover it on Thursday while continuing the search for the sixth.

The discovery made clear the operation to search the hull on the seabed 50 meters (164 feet) underwater had quickly turned into a recovery one, not a rescue, given the amount of time that had passed and with no signs of life emerging over three days of searching.

The Bayesian, a 56-meter (184-foot) British-flagged yacht, went down in a storm  early Monday  as it was moored about a kilometer (a half-mile) offshore. Civil protection officials said they believed the ship was struck by a tornado over the water, known as a waterspout, and sank quickly.

Fifteen people escaped in a lifeboat and were rescued by a nearby sailboat. One body was recovered Monday — that of the ship’s chef, Recaldo Thomas, of Antigua.

Thomas was born in Canada, according to his cousin David Isaac, but would visit his parents’ homeland of Antigua as a child, moving permanently to the tiny eastern Caribbean island in his early 20s. Italian officials previously listed Antigua and Canada as the nationality of people on board.

The fate of six missing passengers had driven the search effort, including British tech magnate Mike Lynch, his 18-year-old daughter and associates who had successfully defended him in a recent U.S. federal fraud trial.

Lynch’s spokesperson did not respond to a request for comment Wednesday.

Meanwhile, investigators from the Termini Imerese Public Prosecutor’s Office were acquiring evidence for their criminal investigation, which they opened immediately after the tragedy  even though no formal suspects have been publicly identified.

Questions have abounded about what caused the superyacht, built in 2008 by Italian shipyard Perini Navi, to sink so quickly, when the nearby Sir Robert Baden Powell sailboat was largely spared and managed to rescue the survivors.

Giovanni Costantino, head of The Italian Sea Group, which owns the shipmaker, blamed human error for the disaster, which he said took 16 minutes. “The ship sank because it took on water. From where, the investigators will say,” he told RAI state television after he met with prosecutors.

Costantino cited AIS ship tracking data which he said showed the Bayesian had taken on water for four minutes when a sudden gust of wind flipped it and it continued taking on water. The ship straightened up slightly and then went down, he said.

But was it merely the case of a freak waterspout that knocked the ship to its side and allowed water to pour in through open hatches? What was the position of the keel, which on a large sailboat like the Bayesian might have been retractable, to allow it to enter shallower ports?

“There’s a lot of uncertainty as to whether it had a lifting keel and whether it might have been up,” said Jean-Baptiste Souppez, a fellow of the Royal Institute of Naval Architects and the editor of the Journal of Sailing Technology. “But if it had, then that would reduce the amount of stability that the vessel had, and therefore made it easier for it to roll over on its side,” he said in an interview.

The captain of the sailboat that came to the Bayesian’s rescue said his craft had sustained minimal damage — the frame of a sun awning broke — even with winds that he estimated reached 12 on the Beaufort wind scale, which is the highest hurricane-strength force on the scale.

He said he had remained anchored with his engines running to try to maintain the ship’s position as the storm, which was forecast, rolled in.

“Another possibility is to heave anchor before the storm and to run downwind at open sea,” Karsten Bornersaid in a text message. But he said that might not have been a viable option for the Bayesian, given its trademark 75-meter (246-foot) tall mast.

“If there was a stability problem, caused by the extremely tall mast, it would not have been better at open sea,” he said.

Yachts like the Bayesian are required to have watertight, sub-compartments that are specifically designed to prevent a rapid, catastrophic sinking even when some parts fill with water.

“So for the vessel to sink, especially this fast, you are really looking at taking water on board very quickly, but also in a number of locations along the length of the vessel, which again indicates that it might have been rolled over on its side,” Souppez said.

Italian coast guard and fire rescue divers continued the underwater search in dangerous and time-consuming conditions. Because of the wreck’s depth, which requires special precautions, divers working in tag teams could only spend about 12 minutes at a time searching, though reinforcements outfitted with special equipment to enable longer dives were also on the wreck Wednesday.

In all, some 27 divers were taking rotations, including four who helped with the recovery of the 2012 Costa Concordia disaster off Tuscany. They called the Porticello wreck a “little Concordia,” fire crews said in a statement, which for the first time Wednesday referred to the operation as a “recovery.”

The limited dive time was designed in part to avoid decompression sickness, also known as the “bends,” which can occur when divers stay underwater for long periods and ascend too quickly, allowing nitrogen gas dissolved in the blood to form bubbles.

“The longer you stay, the slower your ascent has to be,” said Simon Rogerson, the editor of SCUBA magazine. He said the tight turnaround time suggested the operation's managers were trying to limit the risks and recovery time after each dive.

“It sounds like they’re operating essentially on no decompression or very tight decompression, or they’re being extremely conservative,” he said.

Additionally, the divers were working in extremely tight spaces, with debris floating around them, limited visibility and air tanks on their backs.

“We are trying to advance in tight spaces, but any single thing slows us down,” said Luca Cari, spokesman for the fire rescue service. “An electric panel could set us back for five hours. These aren’t normal conditions. We’re at the limit of possibility.”

“It’s not a question of entering the cabin to inspect it,” he added. “They’ve arrived at the level of the cabins, but it’s not like you can open the door.”

In 1809, as a commissioned naval officer, he participated in the Russian action against Sweden. Ten years later he was given command of two ships, Vostok and Mirny, and ordered to explore Antarctica. In 1819 he penetrated 70° South latitude into the Antarctic sea now bearing his name. In the sea he discovered and named Peter I and Alexander I islands. On his return trip to Russia in 1821, Bellingshausen explored the Society Islands, one of which now bears his name. During the Russian war with Turkey (1828-29), he distinguished himself at Varna (now in Bulgaria) and was promoted to vice-admiral. He was later named admiral and was appointed governor of Kronshtadt.

Dan Couchman sets the bar high: ‘One of my ambitions is to make what is truly the most sustainable blue water boat on the planet.’

Sailing, by its very nature, brings people closer to the power and importance of the planet. Many sailors, including ocean yacht racing giants such as Ellen MacArthur and Dee Caffari are leading the change, seeking cleaner oceans and more sustainable models. ‘When you’ve got a global problem, like climate change, it’s a ticking clock,’ states Dan. ‘The market is changing too,’ he adds. ‘You’ve got a younger demographic coming through who are incredibly conscious of the planet, the degradation that’s taking place and the need to do something about it. Increasingly, they will be influencing purchasing decisions. ‘Greener design not only lowers emission levels, but also reduces operating costs and adds to the residual resale value. Critically, if you buy the wrong thing now, it will depreciate at a more rapid rate because the market will not be there in 10 years’ time.’ And so, by embracing this change, DISCOVERY is futureproofing both the business and the boats it produces.

New innovations

New products, such as sustainable resins and composites together with greener power systems and other advancements will be key to achieving Discovery’s goals. ‘We’re working on new methods and materials,’ explains Dan. ‘Were collaborating, for example, with the University of Plymouth, which has a very strong composites department. ‘I think it’s about redefining the building industry landscape by introducing the innovations and experiences that surpass the current industry standards. It’s easy for companies to greenwash, but I’ve spent at least the last 12 years focusing on this. ‘I think if you’ve got the right mindset you’re experimenting, you’re trying things out, you’re willing to change and adapt and bring expertise in. We can react and change quickly, and adopt the correct foundations that are going to be more viable in the longer term.’

Collaborating for change

This all results in DISCOVERY offering a much more sustainable sailing boat, which will feed into the wider marine industry. ‘The way to meet the huge challenge we face is by sharing information,’ says Dan. It’s the only way to accelerate things. Because it’s critical to our DNA, we can afford to be very creative on the sustainability front. I think that small businesses can catalyse change if what they’re doing is the right thing to do. ‘There’s an amazing collective passion and heritage that’s driven the marine industry forward over centuries. We’re saying, build on all the good stuff, but fast track some of these new things now.’

ITOCHU Announces Entry into the Production Phase at Ichyodinskoye Oil Field in Eastern Siberia, Russian Federation

ITOCHU Corporation (headquartered in Minato-ku, Tokyo; Masahiro Okafuji, President & CEO; hereinafter “ITOCHU”) has been participating in the oil and gas exploration activities conducted in the Zapadno-Yaraktinsky Block (hereinafter the “ZY Block”) and Bolshetirsky Block (hereinafter the “BT Block”) located in Irkutsk Oblast, Eastern Siberia, the Russian Federation (hereinafter the “Project”), along with Japan Oil, Gas and Metals National Corporation (hereinafter “JOGMEC”) and INPEX CORPORATION (hereinafter “INPEX”), through Japan South Sakha Oil Co., Ltd. (hereinafter “JASSOC”). A long-term production test aimed at obtaining an accurate assessment of reserves has been conducted on the Ichyodinskoye oil field (hereinafter the “ICH Oil Field”) located in the ZY Block, where oil and natural gas reserves were discovered during previous exploration activities. As a result of the above test, the commercial quantities of reserves of the ICH Oil Field has been confirmed, and therefore, Limited liability Company “Irkutsk Oil Company” (hereinafter “INK”), one of the largest independent oil company, which is the partner company, and JASSOC, decided to enter into the production phase on the ICH Oil Field and it is expected that the approval from the Russian authority can be obtained by the end of 2016. The ZY Block and BT Block are onshore blocks located approximately 700 km north of Irkutsk City, covering an area of approximately 4,835 km 2 and 3,307 km 2 , respectively. The blocks are wholly owned and operated by Joint-Stock Company “INK-Zapad” (hereinafter “INK-Zapad”), a joint venture between INK and JASSOC. The crude oil produced from the ICH Oil Field is expected to be exported from Kozmino Port in the Russian far-east to the Asian market, including Japan, as well as to be supplied to the Russia domestic market, through the Eastern Siberia-Pacific Ocean (ESPO) pipeline. The Project has also confirmed oil and gas accumulations in addition to the ICH Oil Field. It is therefore expected that production testing and other appraisal activities targeting these accumulations will be carried out sequentially going forward. Since Eastern Siberia in the Russian Federation is an area where high oil and gas potential is expected, ITOCHU will continue to focus on expanding its oil and gas exploration and production activities in the area, including further expansion of the Project.

   Listvyanka is located to the southwest of Lake Baikal near the source of the Angara. The settlement stretches in an arc along the coast at the foot of a high stony ridge.

Russian pioneers came to this spot in the middle of the 17th century, and a hundred years later there was a stage-post here. The settlement grew along with the development of navigation on Lake Baikal.

Listvyanka is now a small settlement, but it has shipbuilding and ship-repairing yards of its own.

The Sanatorium and two modern buildings of the Guest Hotel are situated on a picturesque hill above the lake.

You can get to Listvyanka from Irkutsk by bus year-round or aboard the hydrofoils "Voskhod" or "Raketa" in the summer time.

Listvyanka is the site of the Limnological Institute of the Russian Academy of Sciences. It studies the lakes and man-made reservoirs of Siberia and the Russian Far East, with particular focus on Lake Baikal. The institute has a small but very interesting museum of the flora and fauna of Baikal and its region.
